Todd J. McNamara graduated magna cum laude from Chaminade College, Honolulu, Hawaii, in 1974 and secured his law degree with honors from St. John’s University School of Law in 1979. Mr. McNamara was the shareholder in charge of a mid-sized firm’s employment law section for approximately ten years. In 1995, Todd opened his own firm, and limits his practice exclusively to employment law matters. He has lectured on numerous occasions, both locally and nationally, on employment law matters.
Todd was lead private class counsel in Wilkerson, et al., v. Martin-Marietta, the largest age discrimination claim brought within the state of Colorado, which settled for a reported $7.6 million. In LaSelle v. Public Service, Todd secured a $2.1 million judgment on behalf of 90 plaintiffs in an ERISA claim. Mr. McNamara secured the first race discrimination verdict in the United States against a real estate franchise for failure to award a sales agency to an African-American in Tyler v. ReMax. In addition, Todd was co-counsel in Vaszlavik v. Storage Tek, an age discrimination class action which settled for $5 million. Mr. McNamara served as class co-counsel in an ERISA action, Piet, et al. v. Lontine, which settled for $5 million. Most recently, he has settled a two plaintiff sex discrimination case for $1.3 million, a seven person age discrimination case for $2.2 million, a multi-plaintiff disability case for $1.1 million and a race discrimination case for $1.75 million. Todd McNamara, together with class co-counsel, settled a $3.85 million disability discrimination case against the United States Postal Services. Most recently, he secured an $833,000 FLSA settlement, and, as co-counsel, settled an FLSA action for $4.43 million. He has 10 recoveries for his clients in excess of $1 million.
Todd has previously served as co-chair of the Colorado Bar Association Labor Law Committee, and is a member of the National Employment Lawyers Association. He serves as an arbitrator and mediator for the American Arbitration Association Employment Panel. He is editor of Federal Employment Jury Instructions and has just recently completed a seventh supplement to that publication which is used throughout the United States by both lawyers and judges. He is a co-chapter editor with the Practitioners Guide to Colorado Employment Law and has published a number of other articles on employment law issues in both Trial Talk and The Colorado Lawyer. In addition, Todd J. McNamara, P.C. maintains an AV rating, the highest possible, with Martindale-Hubbell and is listed in Martindale-Hubbell’s Bar Register of Preeminent Lawyers, Employment Law. Mr. McNamara has been honored with the designation of Colorado Super Lawyer in 2006, 2007, 2008, 2009, 2010, 2011, 2012, 2013 and 2014. He also has been selected as one of the “Top 50” or “Top 100” lawyers among the more than 24,000 practicing attorneys in the State five times. He is also listed in Best Lawyers in America for Labor and Employment for a number of years. Best Lawyers honored him as the Colorado Employment Lawyer of the Year in 2013. Todd is a Fellow of The College of Labor and Employment Lawyers, one of approximately only 20 in Colorado. He has spoken frequently on employment law issues throughout Canada and the United States in locations as varied as Toronto, Canada, New Orleans, Louisiana, Denver, Colorado, Washington, D.C., Charlotte, North Carolina and Philadelphia, Pennsylvania.
On a personal note, Todd is a passionate baseball fan with divided loyalties between the Rockies, as a season ticket holder, and the Dodgers, who he has cheered for since 1962. He has served or is serving on various Boards such as the Association for Retarded Citizens and Mile High Down Syndrome Association. Todd is an active volunteer at the Denver Zoo both as an assistant zoo keeper and as a guide. Todd enjoys traveling, hiking and camping with his wife, two daughters and two dogs.
